information, education, and communication. Please feel free
to browse the Site. You may download material displayed
on the Site for non-commercial, personal use only provided
you also retain all copyright and other proprietary notices
contained on the materials. You may not, however, distribute,
modify, transmit, reuse, re-post, or use the content of

text, images, audio, and video without Eyeglass World's

without the written permission of Eyeglass World. Eyeglass
World neither warrants nor represents that your use of materials
displayed on the Site will not infringe rights of third
parties not owned by or affiliated with Eyeglass World.
2. While Eyeglass World uses reasonable efforts to include
accurate and up to date information in the Site, Eyeglass
World makes no warranties or representations as to its accuracy.
Eyeglass World assumes no liability or responsibility for
any errors or omissions in the content of the Site.
3. Your use of and browsing in the Site are at your risk.
Neither Eyeglass World nor any other party involved in creating,
producing, or delivering the Site is liable for any direct,
incidental, consequential, indirect, or punitive damages
arising out of your access to, or use of, the Site. Without
limiting the foregoing, everything on the Site is provided
to you "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER
EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE
IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE, OR NON-INFRINGEMENT. Please note that some jurisdictions
may not allow the exclusion of implied warranties, so some
of the above exclusions may not apply to you. Check your
local laws for any restrictions or limitations regarding
the exclusion of implied warranties. Eyeglass World also
assumes no responsibility, and shall not be liable for,
any damages to, or viruses that may infect, your computer
equipment or other property on account of your access to,

materials, data, text, images, video, or audio from the
Site.
4. Images of people or places displayed on the Site are
either the property of, or used with permission by, Eyeglass
World. The use of these images by you, or anyone else authorized
by you, is prohibited unless specifically permitted by these
Terms and Conditions or specific permission provided elsewhere
on the Site. Any unauthorized use of the images may violate
copyright laws, trademark laws, the laws of privacy and
publicity, and communications regulations and statutes.
5. The trademarks, logos, and service marks (collectively
the "Trademarks") displayed on the Site are registered
and unregistered Trademarks of Eyeglass World and others.
Nothing contained on the Site should be construed as granting,
by implication, estoppel, or otherwise, any license or right
to use any Trademark displayed on the Site without the written
permission of Eyeglass World or such third party that may
own the Trademarks displayed on the Site. Your misuse of
the Trademarks displayed on the Site, or any other content
on the Site, except as provided in these Terms and Conditions,
is strictly prohibited. You are also advised that Eyeglass
World will aggressively enforce its intellectual property
rights to the fullest extent of the law, including the seeking
of criminal prosecution.
6. Eyeglass World has not reviewed all of the sites linked
to the Site and is not responsible for the content of any
off-site pages or any other sites linked to the Site. Your
linking to any other off-site pages or other sites is at
your own risk.
7. While we are always happy to hear from you, it is Eyeglass
World's policy not to accept or consider creative materials,
ideas, or suggestions other than those we specifically request.
This is to avoid any misunderstandings if your ideas are
similar to those we have developed independently. Therefore
we must request that you do not send to us any original
creative materials such as original artwork, written works,
attraction ideas, etc. Any communication or material you
do transmit to the Site by electronic mail or otherwise
will be treated as non-confidential and non-proprietary.
Anything you transmit or post may be used by Eyeglass World
or its affiliates for any purpose, including, but not limited
to, reproduction, disclosure, transmission, publication,
broadcast and posting. Furthermore, Eyeglass World is free
to use any ideas, concepts, know-how, or techniques contained
in any communication you send to the Site for any purpose
whatsoever including, but not limited to, developing, manufacturing
and marketing products using such information.
8. Although Eyeglass World may from time to time monitor
or review discussions, chats, postings, transmissions, bulletin
boards, and the like on the Site, Eyeglass World is under
no obligation to do so and assumes no responsibility or
liability arising from the content of any such locations
nor for any error, defamation, libel, slander, omission,
falsehood, obscenity, pornography, profanity, danger, or
inaccuracy contained in any information within such locations
on the Site. You are prohibited from posting or transmitting
any unlawful, threatening, libelous, defamatory, obscene,
scandalous, inflammatory, pornographic, or profane material
or any material that could constitute or encourage conduct
that would be considered a criminal offense, give rise to
civil liability, or otherwise violate any law. Eyeglass
World will fully cooperate with any law enforcement authorities
or court order requesting or directing Eyeglass World to
disclose the identity of anyone posting any such information
or materials.
9. You agree to indemnify, defend and hold Eyeglass World
and its affiliates, and their respective officers, directors,
owners, agents, information providers and licensors (collectively,
the "Indemnified Parties") harmless from and against
any and all claims, liability, losses, costs and expenses
(including attorneys' fees) incurred by any Indemnified
Party in connection with any breach by you of these Terms
and Conditions. Eyeglass World reserves the right, at its
own expense, to assume the exclusive defense and control
of any matter otherwise subject to indemnification by you,
and in such case, you agree to cooperate with Eyeglass World's
defense of such claim.
10. The Site are controlled and operated by Eyeglass World
from within the State of Florida, United States of America.
Eyeglass World makes no representation that materials in
the Site are appropriate or available for use in other locations
and other countries. Those who choose to access the Site
from other locations do so on their own initiative and are
responsible for compliance with local laws, if and to the
extent local laws are applicable. This agreement shall be
governed by, construed and enforced in accordance with the
laws of the State of Florida, as it is applied to agreements
entered into and to be performed entirely within such State.
Any action you, any third party or Eyeglass World bring
to enforce this agreement or, in connection with, any matters
related to this site shall be brought only in either the
state or Federal Courts located in Palm Beach County, Florida,
and you expressly consent to the jurisdiction of said courts.
If any provision of this agreement shall be unlawful, void,
or for any reason unenforceable, then that provision shall
be deemed severable from this agreement and shall not affect
the validity and enforceability of any remaining provisions.
This is the entire agreement between the parties relating
to the matters contained herein and shall not be modified
except in writing, signed by Eyeglass World.
11. Eyeglass World may at any time revise these Terms and
Conditions by updating this posting. You are bound by any
such revisions and should therefore periodically visit this
page to review the then current Terms and Conditions to
which you are bound.
Privacy Policy
Eyeglass World™ is committed to preserving your trust
and confidence. Because your privacy is important to us,
Eyeglass World™ will not sell, rent, trade or share
your personal information collected on this site except
as outlined in this Privacy Policy.
Collection and Use of Data
We may ask you for information that personally identifies
you, such as your name, phone number, e-mail address, and
mailing address. Such personal information is collected
only as part of an explicit registration process, such as
that used in connection with purchasing services, requesting
additional information, participating in contests or surveys,
or registering for one of our training courses or events.

or offers, and to contact you if we need to obtain or provide

Eyeglass World™ about they way in which Eyeglass World™

a request to Eyeglass World™ at Eyeglass World, LLC,

1. The covered categories of personal information disclosed
by Eyeglass World™ to affiliated companies for their
direct marketing purposes during the preceding calendar

2. The names of the affiliated companies sharing the Eyeglass
World™ name which received such information.
You are entitled to receive a copy of this information
in a standardized format and the information will not be
specific to you individually.

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU
MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO
THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Eyeglass World™ uses health information about you
for treatment, to obtain payment for treatment, for administrative
purposes, and to evaluate the quality of care that you receive.
Your health information is contained in a medical record
that is the physical property of Eyeglass World™ or
the optometrist that treated you.
How Eyeglass World™ May Use or Disclose Your
Health Information
For Treatment. Eyeglass World™ may use your health
information to provide you with medical treatment or services.
For example, information obtained by a health care provider,
such as an optometrist, physician, nurse, or other person
providing health services to you, will record information
in your record that is related to your treatment. This information
is necessary for health care providers to determine what
treatment you should receive. Health care providers will
also record actions taken by them in the course of your
treatment and note how you respond to the actions. If you
have been referred into our facility from a healthcare provider
outside of Eyeglass World™, that referring doctor
may have sent information about you in advance to help in
our treatment of you. We will provide your referring healthcare
provider with copies of your record or reports that will
assist him/her in your treatment and health care after you
have completed your management from our facility.
For Payment. Eyeglass World™ may use and disclose
your health information to others for purposes of receiving
payment for treatment and services that you receive. For
example, a bill may be sent to you or a third-party payor,
such as an insurance company or health plan. The information
on the bill may contain information that identifies you,
your diagnosis, and treatment or supplies used in the course
of treatment.
For Health Care Operations. Eyeglass World™ may use
and disclose health information about you for operational
purposes. For example, your health information may be disclosed
to members of the medical staff, risk or quality improvement
personnel, and others to: evaluate the performance of our
staff; assess the quality of care and outcomes in your cases
and similar cases; learn how to improve our facilities and
services; and determine how to continually improve the quality
and effectiveness of the health care we provide.
Appointments. Eyeglass World™ may use your information
to provide appointment reminders or information about treatment
alternatives or other health-related benefits and services
that may be of interest to you. You or a family member may
be contacted by postcard and/or by telephone at the number
you have provided for contact to remind you of an upcoming
appointment.
Notification. Eyeglass World™ may use or disclose
information to notify or assist in notifying a family member,
personal representative, or another person responsible for
your care of your general condition. You have the right
to restrict who we may disclose information to.
Marketing. Eyeglass World™, in compliance with both
Federal and State restrictions, cannot disclose your health
information to third parties for marketing purposes unless
an authorization to do so is obtained from you in advance.
However, Eyeglass World™ may directly market to you
by face-to-face or by mail for research opportunities, services,
procedures or materials offered by Eyeglass World™
that may be of benefit to you. If you do not wish to receive
this information, you have the right to be removed from
our mailing list. Eyeglass World™ may share your personally
identifiable information with affiliated companies in the
execution of marketing programs but these affiliated companies
must comply with our privacy policy.
Required by law. Eyeglass World™ may use and disclose
information about you as required by law. For example, Eyeglass
World™ may disclose information for the following
purposes: for judicial and administrative proceedings pursuant
to legal authority; to report information related to victims
of abuse, neglect or domestic violence; and to assist law
enforcement officials in their law enforcement duties;
Public Health. Your health information may be used or disclosed
for public health activities such as assisting public health
authorities or other legal authorities to prevent or control
disease, injury, or disability, or for other health oversight
activities.
Decedents. Health information may be disclosed to funeral
directors or coroners to enable them to carry out their
lawful duties.
Research. Eyeglass World™ may use your health information
for research purposes when an institutional review board
or privacy board that has reviewed the research proposal
and established protocols to ensure the privacy of your
health information has approved the research. You may be
contacted by telephone or by mail asking to participate
in specific studies at Eyeglass World™ or receive
general information about research opportunities.
Health and Safety. Your health information may be disclosed
to avert a serious threat to the health or safety of you
or any other person pursuant to applicable law.
Government Functions. Your health information may be disclosed
for specialized government functions such as protection
of public officials or reporting to various branches of
the armed services.
Workers’ Compensation. Your health information may

related to Workers’ Compensation.

with your written authorization and you may revoke the authorization
except to the extent Eyeglass World™ has taken action
in reliance on such.
Your Health Information Rights. You have the right to:
request a restriction on certain uses and disclosures or
your information as provided by 45 C.F.R. §164.522;
(however, Eyeglass World™ is not required to agree
to a requested restriction); obtain a paper copy of the
notice of information practices upon request; inspect and
obtain a copy of your health record as provided for in 45
C.F.R. §164.524; request that your health record be
amended as provided in 45 C.F.R. §164.526; request
communications of your health information by alternative
means or at alternative locations; and receive an accounting
of disclosures made of your health information as provided
by 45 C.F.R. §164.528.
Complaints. You may complain to Eyeglass World™ and
to the Department of Health and Human Services (Office of
Civil Rights) if you believe your privacy rights have been
violated. You will not be retaliated against for filing
a complaint.
Obligations of Eyeglass World™. Eyeglass World™
is required by law to: maintain the privacy of protected
health information; provide you with this notice of its
legal duties and privacy practices with respect to your
health information; abide by the terms of this notice; notify
you if we are unable to agree to a requested restriction
on how your information is used or disclosed; accommodate
reasonable requests you may make to communicate health information
by alternative means or at alternative locations; and Eyeglass
World™ reserves the right to change its information
practices and to make the new provisions effective for all
protected health information it maintains. Revised notices
